Um, no. The copyright holders can still sue you in civil court for infringement (especially if said holders sell their work commercially, as it is a record label's business to do). Artists who release their work for free usually ask nothing more than "credit where credit is due," which only applies if they explicitly say so (and many of them do).
Here are our options:
A) Get permission from a copyright holder to use their song, or
B) Use a copyrighted work without permission, put the vid up, pray it doesn't get popular enough to attract the copyright holder's attention, and take it down if they ask you to (and threaten legal action if you do not).
That having been said, anything that's owned by a major record label (and, by extension, just about everything that's ever been done by anyone who's had a hit song) is almost certainly off limits. Folks who release their works for free (such as the fine folks at Overclocked Remix) are far less likely to care if you use their music, although asking permission is always the nice thing to do.

I hear real music in combo videos all the time. Check out some of stuff over at Cyberfanatics. I don't think it's a big deal to use a song in a little internet video clip. Frankly, if we really wanted to talk about copyrights, we'd all be busted for ROM possession.

Only a minute into this but I'm liking it very much. Nice work. :)
edit: Oh man, loved the part five minutes in with the drums as well as the rest after. The credits are almost as long as the movie itself though!
Yeah, I saw the previous version (before the author fixed the URL at the end of the movie), but I've still to watch it with sounds on.
With sounds off, I liked it, though I was chuckled a bit by the occassional DIVX advertisement in the corner...
I think it would be nice if you displayed some creidts as overlay during the actual game clip; just something in the corner like you might see on a music video or game review show. And yeah, I never did really understand the whole obsession with having credit sequences the same length as the main part of the video. It just seems to be an excuse to play another song in entirety.
the credits are a bit long, I'm aware of that, but I though it may be a good occasion to place the whole SMB1 run... the run is short and fit in well... I think...
For the divx advertisemnt, I simply have some vids with that I worked with, and I don't know how to put it of...
Finaly, if most people think the credits are too long and innapropriate, I think I can make an alternate version of it, probably without full-SMB1 run, with a different music and much shorter...

Very nice that you went ahead and did this. I like it.
Some corrections and suggestions:
- Perfectness: the use of default in this sense is archaic. Probably "flaw" or just "fault" would be better.
- Marble Madness was played by Inzult.
- For SMW, the video by Viper has a much better Bowser fight. There are a lot of better flying scenes in that one too (the one on the autoscrolling bridge comes to mind. and the rex dinosaur stomping scene). Actually everything is better in that video.
- The Metroid video bombjumping section has been done much faster by MF, see his thread in the Snes section. The other Metroid clips are still good. Not that important though.
The credits are long, yeah. I'd only include the videos that weren't credited before.
I might sound negative (I've been told I do that a lot) but actually I really liked it. The effects and mixing and clips were very well chosen.

I still don't understand why you can't just send the thing to Bisqwit and have him post a torrent (assuming he'd be willing to do that, that is, but I think he would... right? ^^)
That way, you wouldn't have to worry about things like a global maximum upload rate of 32 kb/s or the file being deleted after 25 downloads or other such nonsense.
well if Bisqwit agrees, I can upload it myself on the server I used for the low quality one, letting him download it and then making a torrent ...
